    IX. International Data Transfer

    Personal data may be shared and processed outside the European Economic Area (the European Economic Area comprises: the European Union, Iceland, Liechtenstein, and Norway, collectively "EEA"). If personal data is transferred outside the EEA, the Controller requires appropriate safeguards. The Controller will fulfil its obligations under Chapter V of the GDPR to ensure the legality of such processing, inter alia, based on European Commission decisions on an adequate level of privacy protection, such as the EU-US Data Privacy Framework.

    1. In connection with the use of OpenAI Pixel, data may be transferred to entities involved in providing OpenAI services, including outside the European Economic Area, if this stems from the relevant terms of service and the organisation of processing. In the event of a data transfer outside the EEA, the Controller ensures the application of an appropriate mechanism compliant with Chapter V of the GDPR. Information on the specific transfer mechanism should be determined based on the current contractual and data protection documentation of OpenAI.

    X. Retention Period for Personal Data

    1. The criteria determining the length of the period for which the Controller stores Users' Personal Data are as follows: The Controller retains copies of Users' Personal Data in a form permitting identification only for as long as is necessary to achieve the purposes set out in this Policy, unless generally applicable law requires a longer retention period. The Controller may, in particular, retain Users' Personal Data for the entire period necessary to establish, exercise, or defend legal claims (limitation of claims in accordance with Art. 118 of the Polish Civil Code).
    2. Personal data is stored:
      1. for a period of 30 days from the moment of contact (telephone, email from the Website), personal data may be processed for a longer period if, as a result of the submitted enquiry, the User decides to use the Controller's services (Newsletter);
      2. in the case of using our services (conclusion of a contract), for the duration of the contract and the period necessary to handle submitted complaints, until potential disputes are resolved and the parties are settled, taking into account the relevant limitation periods for claims;
      3. for the Controller's internal administrative purposes and other data processing purposes where the legal basis is the legitimate interest of the Controller, personal data will be stored until the Controller's legitimate interests constituting the basis for data processing are fulfilled or until an objection to such processing is raised earlier, following an appropriate analysis of the User's interests and the Controller's processing bases;
      4. in the case of data processed on our Fanpage, until an objection to its further processing is raised by clicking "unlike", withdrawing a "like" for a post, removing a comment to a post, or cancelling a Subscription;
      5. in the case of using our Newsletter services, for the duration of the service provision or until consent for sending commercial information by electronic means is withdrawn.
    3. Data related to conversion measurement using the OpenAI Pixel is stored for the period necessary to achieve the measurement purposes, in accordance with the tool's configuration and the relevant OpenAI terms. In a standard setup, OpenAI Pixel may store the **oppref cookie for up to 30 days, and the** obref cookie for up to 365 days. These are retention periods for identifiers in the browser, not the declared retention periods for all data on OpenAI's side. Actual periods may depend on tool configuration, User consent, and browser limitations.

    XI. Google Analytics

    1. The Controller uses the Google Analytics tool provided by Google LLC, whose infrastructure is located at Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The Controller points out that Google LLC (1600 Amphitheatre Parkway, Mountain View, California 94043, USA) has joined the EU-US Data Privacy Framework, i.e., it ensures an adequate level of security for the processing of personal data in accordance with the GDPR.
    2. As part of the use of the IdoSell e-commerce system, Google's tracking tags and scripts (Google Analytics, Google Ads, Google Tag Manager) may be provided via the Website's domain using the Google Tag Gateway feature offered by the IdoSell platform provider (IAI S.A.). Measurement requests are then technically handled through the infrastructure of the Website and IdoSell, and subsequently forwarded to Google for the purposes described below. Designating resources as "first-party" refers solely to the technical method of their delivery and does not mean that the data ceases to be transferred to Google or that it becomes data processed exclusively by the Controller. The application of this mechanism does not alter the processing purposes or legal bases indicated in this section, including the scope of required User consents and the operation of Consent Mode.
    3. Google Analytics allows for:
      1. Website traffic tracking: information about the number of users, number of visits, traffic sources (e.g., ads, search engines, social media).
      2. Monitoring user behaviour: analysing which pages are visited most often, time spent on the page, bounce rate.
      3. User segmentation: demographic, geographic, and technological data (e.g., device type, browser).
      4. Tracking goals and conversions: analysing how users perform specific actions, such as purchases, subscribing to the newsletter, or downloading materials.
    4. Google Analytics processes data, which may include:
      1. IP addresses: used to identify the geographical location of users, which in combination with other data may constitute personal data.
      2. Cookies: storing unique user and session identifiers, enabling the tracking of their activity, only after the User has given appropriate consent.
      3. Technical data: e.g., browser type, operating system, screen resolution, internet service provider.
    5. The Controller uses the IP address anonymisation function, which precludes the identification of Users (the last octet of the IP address is masked before storing or processing the data).
    6. The Controller processes data using the indicated tool in order to provide analyses and reports on website traffic and the effectiveness of marketing activities based on the legitimate interest of the Controller and the User's consent (acceptance of Google Analytics cookies). The Controller has concluded a relevant Data Processing Agreement with Google, regulating data security issues in a manner required by law.
    7. The Controller uses Consent Mode, which allows measuring traffic and conversions on the Website even if the User does not consent to the saving of cookies, while fully complying with GDPR requirements, where a tracking code is implemented to collect only basic, anonymised, and aggregated data regarding visit time on the Website, referrer information, and measuring conversions from ad campaigns. If the User consents to specific types of data processing (Google Analytics cookies), the respective tags will operate fully. If consent is not given, the tools will still function, but in a restricted mode, collecting anonymous data without any possibility of identifying the User. The Consent Mode tool helps meet the requirements stemming from the GDPR and the ePrivacy Directive, respecting Users' decisions regarding cookie consent.
    8. The retention period for collected data in the case of accepting Google Analytics cookies is 14 months.
    9. We encourage you to read the Google Privacy Policy available at: https://policies.google.com/privacy?hl=en
    10. The User may configure their browser to block cookies related to Google Analytics. Google Analytics uses cookies such as _ga, _gid, and _gat.
    11. The User may also use a Google Analytics opt-out browser add-on. Google offers a browser add-on to block Google Analytics, which can be downloaded from the official page: https://tools.google.com/dlpage/gaoptout. Once installed, the add-on will prevent data transmission to Google Analytics from all visited sites.

    XII. Google Ads

    1. The Controller uses Google Ads, an advertising tool provided by Google LLC, whose infrastructure is located at Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The Controller points out that Google LLC (1600 Amphitheatre Parkway, Mountain View, California 94043, USA) has joined the EU-US Data Privacy Framework, i.e., it ensures an adequate level of security for the processing of personal data in accordance with the GDPR.
    2. The Google Ads service allows the use of tracking technologies, such as cookies and remarketing tags, which enable the display of ads tailored to users' interests.
    3. Google Ads may collect and process data regarding users' interactions with our ads and website, including:
      1. IP addresses,
      2. device identifiers,
      3. web browser information,
      4. geolocation data, and
      5. browsing history.
      This data is processed to evaluate the effectiveness of advertising campaigns and optimise advertising content.
    4. Users can manage their ad preferences via Google Ads settings (https://adssettings.google.com) and opt out of personalised ads through the Network Advertising Initiative page: https://www.networkadvertising.org/choices/
    5. We encourage you to read the Google Privacy Policy available at: https://policies.google.com/privacy?hl=en

    XIII. Facebook Pixel

    1. By using the tracking Pixel services provided by Facebook, the Controller becomes a joint controller of personal data together with the service provider, i.e., Meta Platforms Ireland Limited, Block J, Serpentine Avenue, Dublin 4, Ireland. The scope of joint data processing/joint controllership covers:
      1. collection of personal data, and
      2. its transfer to Facebook.
    2. The types of personal data subject to joint controllership with Meta Ireland in connection with the Controller's use of the Pixel product on its website are:
      1. information in HTTP headers, which contains information about the browser or app being used (e.g., user agent, location country/language),
      2. Information regarding standard/optional events, e.g., "Page view" or "app install", further object properties, and buttons clicked by website visitors, depending on the configuration of the Business Tool,
      3. online identifiers, including IP addresses and, if provided, Meta-related identifiers or device identifiers (e.g., mobile OS advertising identifiers), and information about opting out/limiting ad tracking.
      Further data processing by Meta Ireland is not part of the joint data processing with the Audited Party.
    3. Third parties, including Meta, may use cookies, web beacons, and similar technologies to collect or receive information from the website and elsewhere on the Internet and use it to provide measurement services, targeting, and ad delivery. The User may opt out of the collection and use of information about them for ad targeting; detailed information is available at: https://en-gb.facebook.com/business/help/165516217407801?id=1913105122334058. Additionally, the User may use mechanisms allowing them to make a choice (e.g., by providing a link to the pages http://www.aboutads.info/choices and http://www.youronlinechoices.eu/).
    4. We encourage you to read the joint controllership rules specified by Meta, link to the page: https://www.facebook.com/legal/controller_addendum, the Terms of Service for the Pixel product, link to the page: https://www.facebook.com/legal/terms/businesstools, and the mechanisms allowing Users to make a choice regarding its scope.

    XIV. Cookies

    1. The Controller may also use the OpenAI Pixel tool provided by OpenAI to measure the conversion of ads displayed in the ChatGPT service, including product page view events, adding a product to the basket, and making a purchase. In this regard, the following may be processed: event information and URL visited, ad click identifier, online identifiers, technical browser data, as well as transaction value and currency — to the extent transmitted by the implemented integration. The tool may save **oppref cookies (up to 30 days) and** obref cookies (up to 365 days). The OpenAI Pixel is only activated after obtaining the User's consent (Art. 6(1)(a) GDPR); withdrawing consent stops further measurement. Regarding this tool, the Controller and OpenAI generally act as independent data controllers, in accordance with the OpenAI Conversion Terms (https://openai.com/policies/conversion-terms/; technical documentation: https://developers.openai.com/ads/measurement-pixel). The User's rights in this respect are described in the section on the rights of data subjects.

      2. analytical cookies allow us to check the number of visits and traffic sources in our store. They help us determine which pages are more and less popular and understand how users navigate the site. This allows us to study statistics and improve the performance of our store. These files are used exclusively within the scope permitted by applicable law and the User's consent settings.
    8. We use analytics and similar services that contain third-party cookies. While using the Website, third-party cookies may be used to enable the use of Website functionalities and integrated sites or to analyse the effectiveness of advertising campaigns and collect anonymous information about Website usage for statistical purposes.
